75 Pa.C.S. section 3809 (read 2026-09-17) prohibits an "operator or occupant" from possessing an open alcoholic beverage container in a vehicle on a Pennsylvania highway, but exempts "a passenger in the passenger area of a motor vehicle designed, maintained or used primarily for the lawful transportation of persons for compensation. This paragraph includes buses, taxis and limousines." Passengers on a properly operated for-hire bus are covered; the driver is not, under any circumstance. What to ask an operator

Ask for the operator's Pennsylvania PUC certificate number and its USDOT number, which Pennsylvania requires even from in-state carriers, and check the USDOT number on FMCSA's SAFER Company Snapshot.
